Certis APO kicking PMD rider; LTA says that it does not condone any behaviour that deviates from the established rules of engagement

Commenting on the incident where a Certis Cisco Auxillary Police Officer kicked a PMD rider off the road, the Land Transport Authority said in a Facebook post that it does not condone any behaviour that deviates from the established rules of engagement.

According to LTA, a team of LTA Active Mobility Enforcement Officers (AMEOs) and APOs was conducting enforcement duties along Bedok Reservoir Road at about 6.40pm on Tuesday.

When signalled by the APOs to stop, a PMD rider took evasive action. He was subsequently stopped by another APO stationed at the next junction.

As shown in the shocking footage was shared by community-run traffic website, ROADS.sg. on Tuesday (10 Dec), the video captured by a vehicle’s dashcam showed an enforcement officer kicking the rider off his device along Bedok Reservoir Road. Due to the impact of the kick, the rider was seen flying onto the asphalt road.

LTA, SPF and Certis are said to be looking into the incident.

LTA noted that it had contracted Certis Cisco to carry out enforcement and it does not condone any behaviour that deviates from the established rules of engagement.

LTA is also investigating offences committed by the PMD rider, which include riding an unregistered and non-compliant (30.54kg) PMD on public roads, and failing to stop his device when required by an officer. The PMD involved has been impounded.

Based on an update on ROADS.sg’s Facebook page, the man was hurt and was sent by the police to the hospital.

Since 5 November this year, e-scooters were banned on footpaths in Singapore, after Senior Minister of State for Transport Lam Pin Min announced it a day earlier in Parliament.

Although e-scooters are banned from being used on roads and footpaths in the Republic, but it will still be allowed on cycling paths and Park Connector Networks (PCNs).

Those found guilty of the crime can be fined up to S$2,000 and jail time of up to three months once the ban is strictly enforced from 2020.

Application filed to question if prosecution of Daniel De Costa is contravention of Article 12 of the Constitution

An application has just been filed with the State Court on Wednesday (11 Dec) by lawyer, M Ravi on behalf of his client, Daniel De Costa to have De Costa’s criminal defamation case to be stated in the High Court to raise the question as to whether the prosecution of De Costa is a contravention of the equality provision of Article 12 of the Constitution.

De Costa was earlier charged on 13 Dec 2018 in the State Court for the following charge:

‘… that you on 4th September 2018, at about 7:24pm, at an Internet café located in Chinatown, Singapore had defamed members of the Cabinet of Singapore by making an imputation concerning members of the Cabinet of Singapore by words intended to be read, to wit, by sending an email titled ‘PAP MP apologises to SP’ from willysim71@yahoo.com.sg to theonlinecitizen@gmail.com which you had written and which stated that there was ‘corruption at the highest echelons’ intending that the contents of the said email would be published on the website www.theonlinecitizen.com, knowing that such imputation would harm the reputation of members of the Cabinet of Singapore […]”

Published on 4 Sep 2018, the article submitted by De Costa alleged that “we have seen multiple policy and foreign screw-ups, tampering of the Constitution, corruption at the highest echelons and apparent lack of respect from foreign powers ever since the demise of founding father Lee Kuan Yew”.

Mr Ravi in his application, pointed out that other publications, such as the Joint Statement of Dr Lee Wei Ling and Mr Lee Hsien Yang – siblings of Prime Minister Lee Hsien Loong – made similar or worse imputations that were directed squarely at the Prime Minister, a member of the Cabinet.

The application highlights a segment of the Joint Statement by Dr Lee Wei Ling and Mr Lee Hsien Yang where they wrote, “Lee Hsien Loong misused his powers as Prime Minister, and that he hijacked the organs of state to pursue his own personal desires” against De Costa’s offending words, “corruption at the highest echelons”.

It is said that if the statements of the two siblings are not prosecuted, De Costa should similarly not be prosecuted, a fortiori when the statements of the Lee siblings were more direct, and the allegations more severe.

Mr Ravi further pointed to the Court of Appeal decision of Ramalingam Ravinthran(2012) that on an unbiased consideration the same prosecutorial decision should be applied to all parties engaged in the same criminal conduct.

“The prosecution of only Mr. De Costa and Mr Xu Yuanchen. and not the Lee siblings is an infringement upon the right to equality before the law enshrined in Article 12(1). Article 12(1) of the Republic of Singapore Constitution (1999 Reprint) states that “all persons are equal before the law”. – Text of application filed by M Ravi

Under Section 500 of the Penal Code, those found guilty of criminal defamation may be subject to maximum sentence of two years’ imprisonment or a fine or both.

If the application is successful, the charge against De Costa will be quashed.

Article 12(1) of the Republic of Singapore Constitution states:

Equal protection
12.—  (1) All persons are equal before the law and entitled to the equal protection of the law.
(2) Except as expressly authorised by this Constitution, there shall be no discrimination against citizens of Singapore on the ground only of religion, race, descent or place of birth in any law or in the appointment to any office or employment under a public authority or in the administration of any law relating to the acquisition, holding or disposition of property or the establishing or carrying on of any trade, business, profession, vocation or employment.

Is Canadian Tire (TSX:CTC.A) Really Going to Fall 50%?

A renowned short-seller has issued a dire warning for one of Canada’s most well-known retailers. Ben Axler of Spruce Point Capital Management recently opened a short bet against Canadian Tire (TSX:CTC.A). Axler says the company is grossly overvalued and could shed half its valuation in an imminent correction.

Is he right? Axler was right with his last major Canadian short bet. Maxar Technologies stock is down an astonishing 74% since his hedge fund released a bearish report on the stock. So, to find out if history is likely to repeat itself, investors need to take a closer look at Axler’s thesis and Canadian Tire’s underlying fundamentals.

The bearish thesis

The bearish call hinges on the management team’s apparent complacency. Axler argues that Canadian Tire is “falling behind” other major retailers that are much more competitive than it. 

Meanwhile, management has channeled the company’s cash towards dividends and buybacks instead of investing in bolstering their competitive advantage. The stock’s dividend yield currently stands at 3%. The highest rate in the retailer’s recent history.

Another reason the company risks being left behind is its massive physical footprint and lack of online strategy. The corporation owns and manages over 1,700 retail outlets, which could increase its costs and lower margins while competitors have been deploying digital strategies to be price competitive.   

All these reasons seem valid. Canadian Tire could join the list of countless other retailers that have failed in recent years due to similar reasons. Which is why investors need to take a closer look at the fundamentals to judge the risk. 

Tire’s fundamentals

Falling behind the competition is a legitimate concern. However, this concern could be magnified by leverage. In other words, a heavy debt burden may have some role to play if the stock dips dramatically over the short term. 

Canadian Tire currently holds $10.14 billion in debt, which is nearly twice the value of its equity. Spruce Point estimates that the company generates $200 million in free cash flow, which may be inadequate to reduce the debt enough to avoid a ratings downgrade. 

The company’s current debt ratings are BBB by DBRS and BBB+ by S&P, which means any downgrade would push the company’s bonds from investment grade to junk. It doesn’t seem like the company can cope with higher interest rates payments in this hypothetical scenario, especially not if the current dividend payout is maintained. 

All these factors could mean that Canadian Tire is closer to the retail graveyard than investors expect. Management will need to switch the company’s strategy, sell some non-core assets to raise funds, or cut the dividend to manage its debt burden if sales come in below expectations. 

Bottom line

Like several other retailers, Canadian Tire faces enormous competitive pressures from digital giants and foreign multinationals alike. These issues are amplified by the company’s heavy debt burden and massive outlet network. 

Management could still turn things around and use the physical storefronts, and its financial services arm to gain an edge over competitors. However, at the moment, the risks for investors are simply too great to ignore. A 50% drop looks genuinely possible, especially if the debt is downgraded by ratings agencies.
